Tower Hill Park Masterplan Consultation Privacy Notice

This privacy notice explains what information we will collect about you through participation in the Tower Hill Park Masterplan engagement, how we store this information, who we share it with and how we keep it safe and confidential.

We want you to be confident that your information is kept safe, secure and for you to understand how and why we use it. It sets out how Knowsley Council will use data collected from respondents engaging with surveys or speaking with Council Officers at engagement events.

You can decide whether to complete the survey or participate. You can decide how much or how little you wish to participate. Please be aware that, because we do not ask for information that would directly identify you, it is unlikely you would be able to withdraw your answers after you have returned the survey.

Why do you need my information?

We may need to use the information you choose to give to help shape the proposals for the Tower Hill Park Masterplan, which helps us to: -

Achieve the Knowsley Council Plan vision of “supporting Knowsley’s people and communities to thrive” and the three priorities of: -
- Supporting those most in need
- Inclusive skills and growth
- Climate emergency – achieving net zero “where people are active and healthy, and have access to the support they need”, including the priorities of:
Identify whether services, functions and policies are promoting equality of opportunity and good community relations and eliminating unlawful discrimination in line with the Public Sector Equality Duties under the Equality Act 2010.

Knowsley Council will collect and analyse the findings from the engagement on the Tower Hill Park Masterplan to understand the thoughts and aspirations of individuals, businesses, and communities in Knowsley regarding the Council’s proposals to improve the quality and functionality of the park.

Collection of this data will ensure a greater understanding that the consultation relating to the Tower Hill Park Masterplan has engaged a suitable demographic sample from the Knowsley community and surrounding areas, including a range of age groups, genders, ethnic groups and disabilities reflective of the community the Park intends to serve.

Collection of the first 3 Digits of Postcode will help the Council understand the visitor catchment area of the park, whilst also ensuring that the consultation has reached the various neighbourhoods and communities that the Park intends to serve.

The anonymous and aggregated summary data from this engagement may also be used to support headline pieces within local publications such as Knowsley News.

Questions are not mandatory, you may choose to complete all, part or some of the survey.

What Personal Information do we collect?

In order for Knowsley Council Environmental Sustainability Service to offer support within Knowsley we aim to collect all, or some, of the following information from you: -

Age group of respondent
Age group of dependent children of respondent
Gender of respondent
Ethnic group of respondent
Whether respondent considers themselves to have a disability
Whether any dependent children of respondent have a disability
First three digits of postcode (area where respondent lives)

When completing the survey, we may process these parts of your personal data. The survey may appear to be anonymous as we will NOT be asking for any specific personal details that would directly identify you, for example, your name, date of birth, address. However, we may be able to identify you through the collective answers you provide indirectly on the survey, and we are required to make you aware of this.

Your participation is entirely optional.

What allows you to use my information?

Completing the survey is a voluntary act on your part to help us shape proposals for the Tower Hill Park Masterplan.

The legal basis which allows the Council to lawfully process your data falls under the UK General Data Protection Regulation (U GDPR) and is as follows:

Article 6(1) (e) Public task which allows processing which is necessary for the performance of a task carried out in the public interest or in the exercise of official functions, and the task or function has a clear basis in law. The relevant legislation that supports Knowsley Council in processing this information under the lawful basis of public task is the Levelling-up and Regeneration Act 2023 (legislation.gov.uk)

Knowsley Council will be collecting personal data that is defined by the UK GDPR as special category data (e.g. ethnicity, etc.) as part of this survey in line with Article 9(2)(e), which allows the processing of personal information on the basis of substantial public interest. The relevant lawful condition under Schedule 1 of the Data Protection Act 2018 is paragraph 8, equality of opportunity or treatment.

Who will my information be shared with?

Aggregated and anonymous data gathered from this survey and engagement events will be used by Knowsley Council and may be shared with third party consultants such as architects and town planners, development partners and external funding providers as part of any implementation work to improve the community. The Council will not share the data with any other third party.

Do I have to provide this information and what will happen if I don’t?

No, participation is entirely voluntary and not a legal requirement. You can decide whether to participate or not, and you can decide how much or how little you wish to participate. There is a ‘prefer not to say’ option on each question.

How long will you keep this data for and why?

Data will be held by Knowsley Council for a period of up to 5 years following the end of the engagement and consultation period.

How will my information be stored?

Survey data held by Knowsley Council will be stored on a secure Council owned electronic system. Paper (hard) copies will be scanned and uploaded to the secure system and copies will be destroyed through confidential waste.

What rights do I have when it comes to my data?

Under the Data Protection Act (DPA) 2018/ UK General Data Protection Regulation (UK GDPR), you have the following rights with regards to your personal data: -

The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for.
The right to rectification – you have the right to ask the council to correct or remove any inaccurate data that we hold about you.
The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you.
The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems.
The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request.
The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information or complain about how your data is used.
The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour (where applicable)
