This privacy notice explains what information we collect about you, how we store this information, how we share this information and how we keep it safe and confidential. We want you to be confident that your information is kept safe, secure and for you to understand how and why we use it.

The SEND engagement privacy notice will support Knowsley’s community by using the voice of parents, carers and young people as a golden thread in what we do.

Why do you need my information?

The information that is being collected is feedback from members of the community for their thoughts feelings and feedback around SEND Services across Knowsley Borough.

What Personal Information do we collect?

In order for Knowsley the Education and Inclusion Service to offer support within Knowsley. The surveys are anonymous so no personal information will be collected please do not share anything that could identify you.

What allows you to use my information?

For surveys and questionnaires:

The legal basis which allows the Council to lawfully process your data fall under the UK GDPR and the Data Protection Act 2018.

Article 6 (a) Consent By choosing to complete the survey, you give Knowsley Council consent to process the data you provide.

Completing any survey is a voluntary act on your part. Participation is entirely voluntary and not a legal requirement. You can decide whether to complete the survey or not.

Surveys in the main be anonymous and due to this reason, it is unlikely you would be able to retract your contribution once entered or withdraw your consent.

For feedback and engagement sessions:

If personal data is ever required, you will be required to fill out a consent form to fill out the survey or engage with the sessions.

Article 6 (a) Consent By choosing to complete the survey, you give Knowsley Council consent to process the data you provide.

You have the right to withdraw your consent at any time by contacting SENDadmin@knowsley.gov.uk

However, please be aware that your consent is not required where the Council considers processing is necessary under Article 6(1)(e) and Article 9(2)(g) for safeguarding purposes.

For other SEND services

The lawful basis for sharing your information with Government and other Council and commissioned services is UK GDPR Article 6(1)(e) - the processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the Controller.

Where information is sensitive in nature (special category data) we will only share it under the additional condition of UK GDPR Article 9(2)(a) explicit consent or on the basis of Article 9(2)(g) substantial public interest and under Schedule 1 Part 2 (18) of the Data Protection Act 2018 for safeguarding of children and individuals at risk, The Council may need to share additional information to help you to access the range of support/services you require such as information on health, mental health, alleged or committed offences.

Some of your information may be used for safeguarding purposes.

The relevant lawful condition under the Data Protection Act 2018 is Schedule 1, Paragraph 6, statutory and government purposes, as Knowsley Metropolitan Borough Council is authorised to process this information in line with the following pieces of legislation to perform public tasks:

Local authority functions: supporting and involving children and young people

In exercising a function under this Part in the case of a child or young person, a local authority in England must have regard to the following matters in particular:

(a) The views, wishes and feelings of the child and his or her parent, or the young person;

(b) The importance of the child and his or her parent, or the young person, participating as fully as possible in decisions relating to the exercise of the function concerned;

(c) The importance of the child and his or her parent, or the young person, being provided with the information and support necessary to enable participation in those decisions;

(d) The need to support the child and his or her parent, or the young person, in order to facilitate the development of the child or young person and to help him or her achieve the best possible educational and other outcomes.

Who will my information be shared with?

We will never share your personal information for commercial gain or marketing.

Feedback from surveys will only be shared in an anonymous format and responders will not be identifiable.

When we share your personal information, we will only do so where it is necessary and required by law, or you have given your consent.

The types of organisations we may share your information with include:

  • Strategic partners, such as health services, social services and services within the community.

Do I have to provide this information and what will happen if I don’t?

Engagement Surveys are voluntary, and you do not need to participate or provide this information.

In some cases we have an obligation or a power in law to provide this service. This legal duty/power is also the reason we will collect personal data, as we need it to perform our legal duties.

How long will you keep this data for and why?

Anonymous survey data will be stored for 5 years or when the consultation period has ended.

Data will be kept in identifiable form for no longer than necessary as required for the purposes described. Following that, it will be securely deleted or anonymised if it is still required for ongoing statistical and trend analysis purposes.

Personal data will be retained in line with Knowsley Council’s Records Management Policy before being securely destroyed.  Please note that some of the retention requirements for personal data are based on statutory requirements or sectoral recommendations.

How will my information be stored?

The information will be stored on the Council’s secure IT systems with access to your information being restricted to only those staff who need to see it as part of their job role.

Personal information shared with partner agencies will be sent using encrypted email systems, such as through the TLS secured domain list or by Egress secure mail.

Will this information be used to take automated decisions about me?

No

Will my data be transferred abroad and why?

No

What rights do I have when it comes to my data?

Under the Data Protection Act (DPA) 2018/ UK General Data Protection Regulation (UK GDPR), you have the following rights with regards to your personal data: -

  • The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for
  • The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you
  • The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems
  • The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request
  • The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used
  • The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour (where applicable)
