Who will own my data once I submit it? 

Knowsley Metropolitan Borough Council. 

Why do you need my information? 

The Highways and Capital Delivery service will use your data for the following:  

  • To process service requests or enquiries, sharing details with officers and teams so they can take action and respond. 
  • To help us investigate concerns or complaints that are raised.
  • To carry out Highways services. 
  • To take payments for works provided by the Highways Service.

The personal information we hold may include:

  • Your name
  • Your address
  • Your telephone number(s)
  • Your email address
  • Vehicle registration number
  • Payment details (card numbers etc.) which are held securely and encrypted in the Councils Financial systems
  • Site location information provided in your application for a highway service

What allows you to use my information?

In line with Article 6(1)(a) of the UK General Data Protection Regulations (UK GDPR) we will rely on your consent to collect and use your information in most circumstances. However, there may be times when information is used in the legitimate interests of the council, and it may also be shared without your consent. 

We are required to collect and process data to fulfil official public tasks as a public authority, as part of the Councils statutory obligations to provide certain services. This is provided within Article 6 (1)(e) of the UK GDPR by virtue of the following legislation:

  • Road Traffic Regulation Act 1984
  • Highways Act 1980
  • Traffic Management Act 2004
  • New Roads and Street Works Act 1991

Who will my information be shared with? 

To process your enquiry, we will at times need to share the information that you provide with other departments within the Council, or with external partner organisations. 

Data will only be shared where it is lawful to do so, and the necessary arrangements and agreements are in place to comply with UK GDPR for any routine sharing of information.

Equita Debt recovery in relation to penalty charge notices. 
Knowsley Schools  Regarding pupil involvement in road safety event activities. 
Merseytravel To action and respond to enquiries.
Liverpool City Region Combined Authority  To action and respond to enquiries.
Local Authorities  To action and respond to enquiries.
Design Consultants  To inform on scheme development.

Do I have to provide this information and what will happen if I don’t? 

Where information is provided with your consent, you have the choice to not provide this information and to change your mind at any time. However, many services cannot be provided without your information being used. For example, to enable us to action and respond to requests and enquiries, relevant information is required. If the information is not provided, we may not be able to process the enquiry.

How long will you keep this data for and why? 

For no longer than is necessary for the purpose and in accordance with KMBC retention policies. 

How will my information be stored? 

Your information will be stored electronically and securely on the Council’s secure network.

It may also be stored on the secured systems of our partner organisations. Where this is the case, appropriate information government agreements are in place with clear rules on access controls and retention of such information to ensure Data Protection requirements are adhered to. 

All Highways staff have completed mandatory training on data protection and information security. This is provided to all Council staff on an annual basis. 

Will this information be used to take automated decisions about me? 

No.

Will my data be transferred abroad and why? 

No. 

What rights do I have when it comes to my data? 

Under the Data Protection Act (DPA) 2018/ UK General Data Protection Regulation (UK GDPR), you have the following rights with regards to your personal data: -

  • The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for
  • The right to rectification – you have the right to ask the council to correct or remove any inaccurate data that we hold about you
  • The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you
  • The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems
  • The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request
  • The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used
  • The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behavior (where applicable)
