Why do you need my information?

Knowsley Council’s Public Health Service has the responsibility for improving the health and wellbeing of the local population as outlined in the Health and Social Care Act 2012. This includes the power to perform public health functions and the responsibility to deliver and commission several statutory duties and recommended public health services and interventions.

The Healthy Knowsley website has been developed and maintained by Knowsley Public Health Team. We aim to give you information about our public health services, as well as trusted advice and access to local support services to help you take your next step to a healthier you.

We may collect certain personal information from you, for example: your name, your phone number, and your email address and any other information you may provide to us. The type of information we collect will depend on your enquiry. We use your information in a variety of ways:

  • To allow us to communicate with you and provide an appropriate response or signpost you to other Council services appropriate to your needs as per your enquiry email.
  • To allow us to share the personal information that you provide with other Council services and Council commissioned third parties so that they can support you with your enquiry or online self-referral request.
  • To develop relevant public health strategies, policies, plans and services to respond to the need of the borough.
  • To meet any legal requirements the Council is subject to.
  • Where it is necessary to protect individuals from harm or injury.
  • To monitor our performance in responding to your enquiry/comment/feedback.

What Personal Information do we collect?

For Knowsley Council Public Health Service to provide a response or signpost you to support, we may collect all, or some, of the following information from you.

If you send an email to our public health email address we will collect:

Your email address

Any other information you may choose to provide us with such as your name, your address, and/or other personal information or the reason for your email such as your questions, queries or feedback.

However, we ask that you do not include personal identifiable information about yourself here, wait until we contact you direct.

If you complete the online self-referral form for health and wellbeing support:

  • Your name
  • Your email address
  • Your contact phone number (optional)

What allows you to use my information?

Knowsley Council’s Public Health Service has the responsibility for improving the health and wellbeing of the local population.

The Lawful Basis for completing this is:

Article (6)(1)(e)

  • processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;

When we collect or share special category personal data, we rely upon the following legal bases under UK GDPR:

Article 9(2)(g)

  • processing is necessary for reasons of substantial public interest, on the basis of domestic law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject domestic law;

Article 9(2)(h)

  • which states that the processing of special category personal data is necessary for the purposes of the provision of health or social care.

The lawful condition under the Data Protection Act 2018 that governs this processing of personal data is Schedule 1, Part 2, Paragraph 6, statutory and government purposes as outlined in the Health and Social Care Act 2012. This includes the power to perform public health functions and the responsibility to deliver and commission several statutory duties and recommended public health services and interventions.

Who will my information be shared with?

To respond to your enquiry, we may need to share the information that you give us, either with other Council Services or with external Council commissioned third parties.

Some examples of how and why we share your data are:

  • Should you complete the online self-referral form to access health and wellbeing local support, your information will be shared with Council commissioned third parties who deliver services on our behalf. They will contact you directly to process your referral.
  • We may also share your information with other Council Services.  For example, housing, environmental health or highways to provide a response to your enquiry.

Do I have to provide this information and what will happen if I don’t?

We need this information so that we can respond appropriately to your enquiry. For example, if you send an email to the public health email address and if relevant necessary information is not provided, we may not be able to progress your enquiry correctly and may need to ask you for additional information.

How long will you keep this data for and why?

We will only retain information for as long as it is required. Records have different retention periods based their classifications. A copy of the council’s record retention policy and schedule is available on request. These policies are based on Government record retention regulations and best practice.

How will my information be stored?

All information is stored on Knowsley Council secure system. Access to these systems is restricted to those who are entitled to view and process your data.

Will this information be used to take automated decisions about me?

No.

Will my data be transferred abroad and why?

No.

What rights do I have when it comes to my data?

Under the Data Protection Act (DPA) 2018/ UK General Data Protection Regulation (UK GDPR), you have the following rights with regards to your personal data: -

  • The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for.
  • The right to rectification – you have the right to ask the council to correct or remove any inaccurate data that we hold about you.
  • The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you.
  • The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems.
  • The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request.
  • The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used.
  • The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour (where applicable).
