Why do you need my information?
We need your information to carry out Manual Handling Risk Assessments to ensure that personal care is provided safely, appropriately, and in line with legal and professional standards.
These assessments are necessary to:
- Identify risks associated with moving and handling during personal care (e.g. hoisting, transfers, repositioning)
- Ensure your safety, dignity, and wellbeing
- Protect staff and carers from injury
- Inform care and support planning
- Meet legal duties under health and safety and social care legislation
What personal information do we collect?
The information collected may include:
Basic Identifying Information
- Full name
- Date of birth
- Gender
- Address / service location
- NHS number or internal service user reference number (LAS ID)
Contact and Care Coordination Details
- Emergency contact details
- Details of family members, carers or advocates where relevant
- Details of involved professionals (e.g. therapists, social workers)
Health and Special Category Data
- Information relating to physical health, mobility and functional ability
- Details of learning disability, autism or other neurodivergent needs
- Information on manual handling requirements and risks
- Use of mobility aids, hoists or specialist equipment
- Relevant medical conditions that may impact moving and handling
- Behavioural information where this impacts safe handling (e.g. distress, resistance, communication needs)
Care and Support Information
- Care plans and risk assessments
- Manual handling assessments and handling plans
- Environmental information relevant to moving and handling (e.g. bathroom layout, bed type, access constraints)
Visual and Observational Data (where necessary)
- Photographs or videos to support assessment of posture, environment or equipment use (with appropriate consent and safeguards)
Training and Instructional Information (where applicable)
- Information used to inform staff guidance, instruction and safe systems of work relating to the individual service user
This information may include special category data relating to your health.
What allows you to use my information?
We process your personal and special category data under the following lawful bases:
UK GDPR
- Article 6(1)(c): processing is necessary for compliance with a legal obligation to which the controller is subject (see Applicable Legislation below), and
- Article 6(1)(e): processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.
- Article 9 (2) (g): is necessary for reasons of substantial public interest
- Article 9(2)(h) processing is necessary for the provision of health or social care or treatment or the management of health or social care systems and services and

Who will my information be shared with?
Your information may be shared with:
- Employees and managers responsible for planning and delivering your care
- Other professionals involved in your care where necessary including third-party Manual Handling Assessor contracted by us
Information will only be shared where it is lawful, necessary, and proportionate, for example for safeguarding purposes.
Do I have to provide this information?
No.
Please note that Manual Handling Risk Assessments are essential to ensure that care can be provided safely.
If you choose not to provide this information, it may not be possible to deliver personal care safely or appropriately.
How long will you keep my information?
Manual Handling Risk Assessment records will be kept:
- For as long as you receive services from us
- In line with social care and health and safety retention requirements
Where services end, records will be retained in accordance with statutory retention schedules and Care Quality Commission (CQC) guidance.
- Manual Handling Assessment documents, referrals or any other document created by Together We Care teams shared with the successful supplier should be kept for 6 years after the last works completed.
How will my information be stored?
Your information will be stored electronically on a council secured server. This will prevent any unauthorised/unlawful processing. It will also prevent accidental loss, destruction or damage from a technical and operational perspective as IT have backup systems in the case of such eventualities.
Will this information be used to make automated decisions about me?
No. Decisions about your care and manual handling support are made by trained professionals and are not automated.
Will my data be transferred outside the UK?
No. Your information will be stored and processed within the UK.
What rights do I have when it comes to my data?
Under the Data Protection Act (DPA) 2018/ UK General Data Protection Regulation (UK GDPR), you have the following rights with regards to your personal data: -
- The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for
- The right to rectification – you have the right to ask the council to correct or remove any inaccurate data that we hold about you
- The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you
- The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems
- The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request
- The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used
- The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour (where applicable)
