Who will own my data once I submit it?

Why do you need my information?

To offer a Health and Wellbeing course through Family and Community Education to help enhance mental health and wellbeing, as well as learn different fine art techniques.

Your information will also be used for research purposes for a PhD at Liverpool Hope University.

  • To measure impact on what the arts can do for mental health and wellbeing
  • To document a journey over the course
  • To help develop a two-year art and wellbeing programme.

What allows you to use my information?

The relevant lawful bases for KMBC’s processing of any personal data personal data that may be shared between the partners are as follows:

For the provision of the course:

Article 6(1)(e) of the UK GDPR :

Processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller and to meet our statutory responsibilities.

To process special category data the lawful basis is:

Article 9(2)(g) of the UK GDPR :

Substantial public interest.

Processing is necessary for reasons of substantial public interest, on the basis of Union or Member State law which shall be proportionate to the aim pursued, respect the essence of the right to data protection and provide for suitable and specific measures to safeguard the fundamental rights and the interests of the data subject.

The legislation underpinning this processing is:

The Apprenticeships, Skills, Children and Learning Act 2009.

The data subject has given consent to the processing of his or her personal data for one or more specific purposes.

Participants have the right to withdraw their consent at any time and Knowsley Council will destroy their data.

Who will my information be shared with?

Liverpool City Region Combined Authority (LCRCA) and the Department for Education (DfE) to ensure accuracy of information held in relation to the funding of learning.

Where Learners claiming out of work benefits, LCRCA must provide data to the Secretary of State with responsibility for unemployment or their nominated representative in accordance with the requirements notified to Knowsley FACE.

  • Knowsley FACE will provide personal information to the Data Service to enable the ULN to be generated.
  • Knowsley FACE will share information with internal teams and other Council departments, such as Knowsley Works, to provide impartial Information Advice and Guidance to support learners in making next steps.
  • Knowsley FACE may share your personal information with other education providers for the purpose of your continued learning.

The information collected for the research project will only be used for research purposes towards a PhD. When the PhD is finished that data will be published as an open access publication. However, all information collected will be anonymised. Open Access is a shared online platform accessible to the public.

Do I have to provide this information and what will happen if I don’t?

This research project is optional. It is your choice to take part if you want to. Participating in the exhibition, photography, filming, audio recordings or Thought Journal. Is entirely optional and we use your consent to process this data.

However, if you decide to and change your mind, your consent can be withdrawn at any time. You can do this by emailing knowsleyface@knowsley.gov.uk and they will withdraw your consent.

How long will you keep this data for and why?

Data about the course will be kept in accordance with national retention polices.

We will keep your data for a maximum of 7 years from the end of the academic year once you have ended your learning activity, after which it will be securely destroyed.

We may need to keep your personal information indefinitely for research and statistical purposes. We will put in place necessary measures to safeguard this information.

Data for the research project will be kept for 3 years after the project has been completed.

Data used for research purposes will be anonymised and available to view as an open access publication.

How will my information be stored?

Information will be stored securely on our IT system. Access to the systems is restricted to those who are entitled to view and process your data.

Any diaries will be locked in a cupboard and there will be a ‘sign in and sign out’ sheet if any learners wish to take them home.

Will this information be used to take automated decisions about me?

What rights do I have when it comes to my data?

Under the Data Protection Act (DPA) 2018/ UK General Data Protection Regulation (UK GDPR), you have the following rights with regards to your personal data: -

  • The right to subject access – you have the right to see a copy of the personal data that the council holds about you and find out what it is used for.
  • The right to rectification – you have the right to ask the council to correct or remove any inaccurate data that we hold about you.
  • The right to erasure (right to be forgotten) you have the right to ask the council to remove data that we hold about you.
  • The right to restriction – you have the right to ask for your information to be restricted (locked down) on council systems.
  • The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request.
  • The right to object – you have the right to ask the council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used.
  • The right to prevent automated decision making – you have the right to ask the council to stop using your data to make automated decisions about you or to stop profiling your behaviour (where applicable).
