Environmental Health use of CCTV

This privacy notice sets out how Knowsley Council Environmental Health will use personal data collected from the use of CCTV cameras.  It also describes your rights in relation to your personal data.  Knowsley Council are controllers of the personal data collected and processed during this exercise.

Why do you need my information?

Knowsley Council collects CCTV images which are used to assist investigations into environmental crime, such as fly tipping.  The data collected can be used to identify individuals and vehicles involved in the act and can subsequently result in prosecuting those who commit crime.

What allows you to use my information?

The legal basis for using your information is that it is in the public interest for the council to prosecute fly tippers and those who carry out environmental crime, and to reduce the incidents of fly tipping within the borough.

Our lawful basis for doing this is Article 6(1)(e) of the GDPR – public task.
The legislation we will rely on is:

  • to investigate unauthorised or harmful deposits, treatment or disposal etc. of waste (s33 Environmental Protection Act 1990, The Unauthorised Deposit of Waste (Fixed Penalties) Regulations 2016) and s2 and s6 the Refuse Disposal (Amenity) Act 1978 (RDA), where there are no others means to do so,
  • to ensure residents and businesses are compliant with s34 Environmental Protection Act 1990 by publicising the issuing of fixed penalties (as per the Environmental Protection (Miscellaneous Amendments) (England and Wales) Regulations 2018) and successful prosecutions
  • s59 of Environmental Protection Act 1990 in order to require the removal of waste unlawfully deposited
  • Prevention of Damage by Pests Act 1949 – statutory duty to control pests within the borough for which fly tipping is a contributor
  • Anti-Social Behaviour Crime and Policing Act 2014 – to avoid any instances where anti-social behaviour can impact the community, for which fly tipping has a link to other criminality and encourages further waste issues
  • Public Health Act 1961, power to deal with any rubbish which is in the open air and is seriously detrimental to the amenities of the community

Who will my information be shared with?

We will only share data with other departments and agencies if there is a lawful basis to do so, for example to reduce crime and disorder.  Examples include:

Enforcement We may need to pass on details to our Enforcement service to investigate any incidents of littering or other environmental crimes
Registered Social Landlords Information may be shared if details are required as part of an investigation of a criminal act
Other public bodies Information may be shared with bodies such as the Environment Agency if the details are relevant and assist with any investigation of crime
Local Authorities Information may be shared if there are joint investigations between KMBC and other Local Authorities to detect crime
Merseyside Police Information may be shared with Police to investigate crime and disorder
Community Safety Information may be shared with Crime and Communities to investigate crime and disorder
Enforcement We may need to pass on details to our Enforcement service to investigate any incidents of littering or other environmental crimes
 

How long will you keep this data for and why?

We will keep your information for as long as it is required by us or other regulatory bodies in order to comply with legal and regulatory requirements or for other operational reasons. In most cases this will be a minimum of six years

How will my information be stored?

Images are recorded onto an encrypted SD card, located within the camera which is replaced at least every 7 days, uploaded using encryption keys onto secure KMBC systems and if shared, will be done so securely using an egress system.

Will this information be used to take automated decisions about me?

What rights do I have when It comes to my data?

The General Data Protection Regulation provides a number of rights regarding how your personal data is processed:

  • The right to subject access – you have the right to see a copy of the personal data that the Council holds about you and find out what it is used for.
  • The right to rectification – you have the right to ask the Council to correct or remove any inaccurate data that we hold about you.
  • The right to erasure (right to be forgotten) you have the right to ask the Council to remove data that we hold about you.
  • The right to restriction – you have the right to ask for your information to be restricted (locked down) on Council systems
  • The right to data portability – you have the right to ask for your data to be transferred back to you or to a new provider at your request.
  • The right to object – you have the right to ask the Council to stop using your personal data or to stop sending you marketing information, or complain about how your data is used.
  • The right to prevent automated decision making – you have the right to ask the Council to stop using your data to make automated decisions about you or to stop profiling your behaviour. (where applicable)
  • You have the right under the Data Protection Act 1998 (General Data Protection Regulation) to request a copy of your information and to know what it is used for and how it has been shared. This is called the right of subject access.
