Is my petition valid?
When the council receives a petition, the
Petitions Officer (who is also the council’s Monitoring Officer)
first looks at whether it is ‘valid’ under the Scheme.
The information below will help you to understand how the
Petitions Officer will decide if the petition is valid.
1. Does your petition have ALL of the
following?
- A clear statement setting out the subject of the petition and
what you want the council to do in response to it? It must relate
to matters that directly affect Knowsley and to matters that the
council or its partners can influence directly.
- The name and postal address of the person the council should
write to (usually the ‘petition organiser’')
- Valid names, addresses and signatures of at least 50
people?
(NB In this instance ‘valid’ means people who live, work or
study in Knowsley. For example, if the person signing the petition
only works in Knowsley and does not live there, then he/she must
write down the address of their place of work. If he/she wrote down
their home address, which was outside of Knowsley, the signature
would be ‘invalid’.)
If the answer to any of these questions is
‘no’
The petition will be ‘invalid’. Where a submitted petition is
invalid, we will contact the petition organiser to say why. Details
of the petition will be included in the petition register on the
council’s website with an explanation of why it is invalid.
2. Does your petition relate to any of the
following?
- Planning or licensing issues?
- Traffic Regulation Orders?
- A matter where an individual or organisation has another
statutory right of appeal?
- Other statutory petitions – for example a request for a mayoral
referendum?
If the answer is ‘no’.
This will be a valid petition unless, in the view of the
council’s Monitoring Officer (who is also the ‘Petitions Officer’),
the petition is vexatious, abusive or otherwise inappropriate, or
substantially the same as one submitted to, and considered by, the
council within the last six months.
