Gating Order - Oldfield/Castlewell, Whiston

This Order is made by Knowsley Metropolitan Borough Council ("the Authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Oldfield/Castlewell area of Whiston.

By this Order:

  1. The public right of way over the passageways specified in Schedule 1 to this Order and coloured black on the attached plans will be restricted at all times by the erection of barriers at the ends of the passageways.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative routes for pedestrians will be as specified in Schedule 2 to this Order.
  4. The occupiers of the properties numbered 1 to 5 inclusive (odds and evens) Oldfield; 25 to 31 (odds) Dragon Lane; 1 to 16 (odds and evens) Castlewell; 16 to 26 (evens) Hulton Avenue; 2 to 18 (evens) Stoney Lane and 38 and 40 The Crescent are excluded from the effects of the restriction referred to in paragraph 1 above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.

Schedule 1
Passageways to be restricted:

a) the alley way to the rear of numbers 16 to 22 Hulton Avenue and numbers 11 to 16 Castlewell, a length of approximately 50 metres as shown on Drawing No. NR/PWC/RA/GO1004A.

b) the footpath adjacent to the northerly boundary of number 1 Oldfield and to the rear of numbers 2 to 8 Stoney Lane, a length of approximately 20 metres as shown on Drawing No. NR/PWC/RA/GO1005A.

c) the footpath which runs between number 5 Oldfield and number 25 Dragon Lane, a length of approximately 10 metres as shown on Drawing No. NR/PWC/RA/GO1006A.

d) the alley way which runs along the westerly boundary of number 1 Castlewell and then to the rear of numbers 1 to 10 Castlewell, a length of approximately 70 metres as shown on Drawing No. NR/PWC/RA/GO1007A.

Schedule 2
Details of alternative routes for pedestrians:

a) Alley way to rear of numbers 11 to 16 Castlewell.

From a point adjacent to the most southerly point of number 11 Castlewell in a north-westerly direction along the frontage of numbers 11 to 16 Castlewell for a distance of approximately 30 metres, then along the side of number 16 Castlewell in an easterly direction to the most northerly point of number 16 Castlewell, a distance of approximately 20 metres and vice versa as indicated on Drawing No. NR/PWC/RA/GO1004B.

b) Footpath between number 1 Oldfield and rear of number 2 Stoney Lane.

From a point at the front of number 1 Oldfield in a south-westerly direction to the footpath fronting number 8 Castlewell, a distance of approximately 60 metres, then in a north-westerly direction to the front boundary of number 31 Dragon Lane, a distance of approximately 25 metres, then in a north-easterly direction to the rear of number 1 Oldfield, a distance of approximately 60 metres and vice versa as indicated on Drawing No. NR/PWC/RA/GO1005B.

c) Footpath between number 5 Oldfield and number 25 Dragon Lane.

From a point to the rear of number 25 Dragon Lane in a south-westerly direction to the footpath fronting number 8 Castlewell, a distance of approximately 20 metres, then in a north-westerly direction to the front boundary of number 31 Dragon lane, a distance of approximately 25 metres, then in a north-easterly direction to the most northerly point of number 25 Dragon lane, a distance of approximately 23 metres and vice versa as indicated on Drawing No. NR/PWC/RA/GO1006B.

d) Alley way at rear of numbers 1 to 10 Castlewell.

There is no requirement for an alternative route at this location as the alley way has only one access point and is only used as access for the rear of numbers 1 to 10 Castlewell as indicated on Drawing No. NR/PWC/RA/GO1007.
