Gating Order - Edward Road/Gilbert Road, Whiston

This Order is made by Knowsley Metropolitan Borough Council (“the Authority”) under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Edward Close and Gilbert Road area of Whiston.

By this Order:

  1. The public right of way over the passageway leading from its junction with Edward Road in a north-westerly direction to its junction with Gilbert Road in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers at the south eastern end of the passageway leading from Edward Road and the north western end of the passageway leading from Gilbert Road.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative route for pedestrians will be via Edward Road, Warrington Road and Gilbert Road and vice versa.
  4. The occupiers of the properties numbered 2a Gilbert Road; 1 to 7 (odd)
    Edward Road; 1 and 3 Susan Walk and 181 to 191 (odd) Warrington
    Road are excluded from the effects of the restriction referred to in
    paragraph 1 above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.
