Gating Order - Custley Hey, Stockbridge Village

By this Order:

  1. The public right of way over the passageway commencing adjacent to the north-westerly boundary of number 106 Custley Hey and continuing in a south-easterly direction for a distance of approximately 25 metres to its junction with Custley Hey in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers at the north-westerly and south-easterly ends of the passageway.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative route for pedestrians will be via the footway commencing at the most north-easterly point of number 106 Custley Hey and continuing in a south-westerly direction for a distance of approximately 63 metres to the south-easterly boundary of number 97 Custley Hey, then in a north-westerly direction for a distance of approximately 60 metres to a point adjacent to the easterly boundary of number 64 Woodfarm Hey, then in a north-easterly direction for a distance of approximately 64 metres to a point adjacent to the easterly boundary of number 46 Woodfarm Hey, then in a south-easterly direction for a distance of approximately 32 metres and vice versa.
  4. The occupiers of the properties numbered 106 and 119 to 122 inclusive (odds and evens) Custley Hey are excluded from the effects of the restriction referred to in paragraph 1 above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.
