Gating Order - Round Hey, Stockbridge Village

By this Order:

  1. The public right of way over the passageways specified in Schedule 1 to this Order and coloured dark grey on the attached plans, will be restricted at all times by the erection of barriers at the ends of the passageways.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative routes for pedestrians will be as specified in Schedule 2 to this Order.
  4. The occupiers of the properties numbered 67 to 78 inclusive (odds and evens), 85, 94, 95, 98, 99, 112, 112a, 118, 118a, 125, 125a, 126, 126a, 127, 128, 129, 135, 136, 137, 138, 161, Round Hey and St Jude’s Church, Round Hey are excluded from the effects of the restriction referred to in paragraph 1above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.

Schedule 1
Passageways to be restricted:

a) the footpath to the rear of numbers 67 to 74 Round Hey, a length of approximately 43 metres as shown on plan number NR/NH/KJ/GO1002.

b) the footpath between numbers 126 and 126a Round Hey, a length of approximately 18 metres as shown on plan number NR/NH/KJ/GO1003.

c) the footpath to the rear of numbers 135 to 137 Round Hey, a length of approximately 22 metres as shown on plan number NR/NH/KJ/GO1004.

d) the footpath fronting 118a and 125a Round Hey, a length of approximately 40 metres as shown on plan number NR/NH/KJ/GO1005.

e) the footpath between numbers 94/95 and 112a/118a Round Hey, a length of approximately 20 metres as shown on plan number NR/NH/KJ/GO1006.

f) the footpath between numbers 98/99 and 112/112a Round Hey, a length of approximately 19 metres as shown on plan number NR/NH/KJ/GO1007.

g) the footpath adjacent to the gable end of number 161 Round Hey, a length of approximately 15 metres as shown on plan number NR/NH/KJ/GO1008.

Schedule 2
Details of alternative routes for pedestrians:

a) Footpath to the rear of numbers 67 to 74 Round Hey

From a point adjacent to the most westerly point of number 85 Round Hey in a north-westerly direction for a distance of approximately 25 metres, then along the frontage of numbered 67 to 78 Round Hey in a north-easterly direction for a distance of approximately 65 metres to the most northerly point of number 78 Round Hey, then in a south-easterly direction for a distance of approximately 23 metres to the path fronting numbers 126 to 129 Round Hey and vice versa, as indicated on plan number NR/NH/KJ/GO1002.

b). Footpath between numbers 126 and 126a Round Hey

From a point between numbers 126 and 126a Round Hey in a north-easterly direction for a distance of approximately 55 metres, to the rear of property number 138 Round Hey, then in a south-easterly direction for a distance of approximately 68 metres to number 149 Round Hey, then in a north-easterly direction for a distance of approximately 23 metres to the front of block numbered 138 to 149 Round Hey, then in a north-westerly direction for a distance of approximately 94 metres to number 137 Round Hey, then in a south-westerly direction for a distance of approximately 63 metres to number 126 Round Hey and vice versa, as indicated on plan number NR/NH/KJ/GO1003.

c) Footpath to the rear of numbers 135 to 137 Round hey

From a point to the rear of number 135 Round Hey in a south-westerly direction for a distance of approximately 68 metres to the rear of number 149 Round Hey, then in a north-easterly direction for a distance of approximately 23 metres to the front of block numbered 138 to 149 Round Hey, then in a north-westerly direction for a distance of approximately 68 metres to the most northerly point of number 138 Round Hey and vice versa, as indicated on plan number NR/NH/KJ/GO1004.

d) Footpath fronting numbers 118a and 125a Round Hey

From 118a Round Hey in a north-easterly direction for a distance of approximately 42 metres, then in a north-westerly direction for a distance of approximately 40 metres, then in a south-westerly direction for a distance of approximately 43 metres to number 125a Round Hey and vice versa, as indicated on plan number NR/NH/KJ/GO1005.

e) Footpath between numbers 94/95 and 112a/118a Round Hey

From the front boundaries of properties numbered 94 and 95 Round Hey in a south-easterly direction for a distance of approximately 77 metres to a point at the most southerly boundary of number 99 Round Hey, then in a north-easterly direction for a distance of approximately 55 metres to the easterly boundary of number 106 Round Hey, then in a north-westerly direction for a distance of approximately 68 metres to the front of property number 107 Round Hey, then in a south-westerly direction for a distance of approximately 50 metres to numbers 112a and 118a Round Hey and vice versa, as indicated on plan number NR/NH/KJ/GO 1006.

f) Footpath between numbers 98/99 and 112/112a Round Hey

From a point on Round Hey between the boundaries of properties numbered 98 and 99 Round Hey in a south-easterly direction for a distance of approximately 27 metres to the most southerly point of property number 99 Round Hey, then in a north-easterly direction for a distance of approximately 55 metres to the easterly boundary of property number 106 Round Hey, then in a north-westerly direction for a distance of approximately 68 metres to the front of property number 107 Round Hey, then in a south-westerly direction for a distance of approximately 45 metres to property numbers 112 and 112a Round Hey and vice versa, as indicated on plan NR/NH/KJ/GO1007.

g) Footpath adjacent to the gable end of number 161 Round Hey

From the southern most point of number 161 Round Hey in a north-westerly direction for a distance of approximately 100 metres to number 150 Round Hey, then in a north-easterly direction for a distance of approximately 16 metres to the northern most point of number 150 Round Hey, then in a south-easterly direction for a distance of approximately 100 metres to the rear of number 161 Round Hey and vice versa, as indicated on plan number NR/NH/KJ/GO1008.
