Gating Order - Lancaster Walk, Huyton

By this Order:

  1. The public right of way over the passageway commencing at its junction with Hurst Park Drive, between numbers 66 and 68 Hurst Park Drive and continuing in a north-westerly direction for a distance of approximately 16 metres to its junction with Lancaster Walk between number 10 LancasterWalk and the rear boundary of number 66 Hurst Park Drive in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers at each end of the passageway.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative route for pedestrians will be via Hurst Park Drive from the boundary to the front of numbers 66 and 68 for a distance of approximately 90 metres in a southerly direction to Wallace Avenue, then in a westerly direction for a distance of approximately 45 metres to Lancaster Road, then in a northerly direction for a distance of approximately 92 metres to Lancaster Walk, then in an easterly direction for a distance of approximately 48 metres to number 10 Lancaster Walk and vice versa.
  4. The occupiers of the properties numbered 66 and 68 Hurst Park Drive and 10 Lancaster Walk, Huyton are excluded from the effects of the restriction referred to in paragraph 1 above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.
