Gating Order - Rimmer Avenue, Huyton
This Order is made by Knowsley Metropolitan Borough Council ("the Authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Rimmer Avenue area of Huyton.
By this Order:
- The public right of way over the passageway leading from Court
Hey Drive to the passageway at the rear of Rimmer Avenue Shops and
from Rimmer Avenue to the passageway at the rear of Rimmer Avenue
Shops in the Metropolitan Borough of Knowsley will be restricted at
all times by the erection of barriers at the western and eastern
ends of the passageway leading from Court Hey Drive and the eastern
ends of the passageways leading from Rimmer Avenue between number 2
Rimmer Avenue and the garage site; numbers 12 and 14 Rimmer Avenue
and numbers 24 abd 26 Rimmer Avenue.
- The Authority are satisfied that:
(a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
(b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
(c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour. - The alternative route for pedestrians will be via Court Hey
Drive, Court Hey Road, Rimmer Avenue and vice versa.
- The occupiers of the properties numbered 2, 2a, 2b, 4, 4a,
4b, 6, 6a, 6b, 8, 8a, 8b, 10, 10a, 10b, 12, 12a, 12b, 14, 14a,
14b, 16, 16a, 16b, 18, 18a, 18b, 20, 20a, 20b, 22, 22a, 22b, 24,
24a, 24b and 26, Rimmer Avenue and 33 to 57 (odd numbers only)
Court Hey Drive, Huyton are excluded from the effects of the
restriction referred to in paragraph 1 above.
- Police, Fire and Ambulance emergency services, statutory
undertakers with equipment situated over, along or in the highway,
council officers and other persons authorised in writing by the
council for the purposes of carrying out works of repair or
maintenance to the highway or ajoining premises shall be exempt
from the provisions of this Order.
- The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.
If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.
