Gating Order - Boode Croft, Stockbridge Village

 

By this Order:

  1. The public right of way over the passageway to the rear of numbers 149 to 161 Boode Croft and 196 to 209 Boode Croft in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of a barrier at the southern end of the passageway.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. There is no alternative route for pedestrians.
  4. The occupiers of the properties numbered 147 to 162 inclusive (odds and evens) and 195 to 210 inclusive (odds and evens) Boode Croft are excluded from the effects of the restriction referred to in paragraph 1. above
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.

The Common Seal of the Council of the Metropolitan Borough of Knowsley was hereunto affixed 14 March 2007.
