Gating Order - Woodfarm Hey, Stockbridge Village

By this Order:

  1. The public right of way over the passageway commencing adjacent to the north-westerly boundary of number 79 Woodfarm Hey and continuing in a southerly direction to the north-easterly boundary of number 82 Woodfarm Hey, then in an easterly direction to a point between numbers 75 and 76 Woodfarm Hey in the Metropolitan Borough of Knowsley, a total distance of approximately 48 metres, will be restricted at all times by the erection of barriers at the northern, southern and eastern ends of the passageway
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative route for pedestrians will be via the footway fronting numbers 76 to 79 Woodfarm Hey in a northerly direction for a distance of approximately 48 metres, then the footway fronting numbers 79 to 93 Woodfarm Hey in a westerly direction for a distance of approximately 63 metres, then in a southerly direction for a distance of approximately 46 metres to the south-westerly boundary of number 93 Woodfarm Hey, then in an easterly direction to the south-easterly boundary of number 88 Woodfarm Hey and vice versa.
  4. The occupiers of the properties numbered 74 to 79 (odds and evens) Woodfarm Hey inclusive and 82 to 93 (odds and evens) Woodfarm Hey inclusive are excluded from the effects of the restriction referred to in paragraph 1 above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.
