Gating Order - Blacksmith Place, Halewood

Highways Act 1980
This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Blacksmith Place area of Halewood.
By this Order:
- The public right of way over the highway commencing at a point
adjacent to the south-easterly boundary of number 7 Blacksmith
Place and continuing for a distance of approximately 66 metres in
an easterly direction to end between numbers 80 and 82 Arncliffe
Road in the Metropolitan Borough of Knowsley will be restricted at
all times by the erection of barriers at the westerly end of the
passageway between number 7 Blacksmith Place and number 11 Blay
Close and the eastern end of the passageway between numbers 80 and
82 Arncliffe Road
- The Authority are satisfied that:
(a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
(b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
(c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour. - The alternative route for pedestrians affected by the
restrictions is from number 82 Arncliffe Road in a southerly
direction for a distance of approximately 84 metres then in a
westerly direction for a distance of approximately 145 metres along
Arncliffe Road to its junction with Sherborne Avenue then in a
northerly direction for a distance of approximately 92 metres along
Sherborne Avenue to its junction with Blacksmith Place then in an
easterly direction for a distance of approximately 65 metres along
Blacksmith Place.
- The occupiers of the properties numbered 21 to 27 (inclusive)
Pembrey Way, 11, 15, 20, 22 and 24 Blay Close, 80 and 82 Arncliffe
Road and number 7 Blacksmith Place are excluded from the effects of
the restrictions referred to in paragraph 1.above.
- Police, Fire and Ambulance emergency services, statutory
undertakers with equipment situated over, along or in the highway,
council officers and other persons authorised in writing by the
council for the purposes of carrying out works of repair or
maintenance to the highway or ajoining premises shall be exempt
from the provisions of this Order.
- The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.
If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.
The Common Seal of the council was affixed on 26 March 2008.
