Gating Order - St James Road/Mine’s Avenue/Sutherland Road/Scotchbarn Lane

Highways Act 1980

This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the St James Road/Mine’s Avenue/Sutherland Road/Scotchbarn Lane area of Prescot

By this Order:

  1. The public right of way over the passageway at the rear of numbers 29 to 47 Scotchbarn Lane marked A on the attached plan; at the rear of numbers 10 to 46 St James Road and 1 to 27 Mines Avenue marked A to B on the attached plan; between the northerly boundaries of numbers 46 St James Road and 27 Mine’s Avenue marked B on the attached plan; at the rear of numbers 49 to 67, Scotchbarn Lane marked C on the attached plan and the rear of numbers 69 to 77 Scotchbarn Lane marked D on the attached plan, in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative routes for pedestrians affected by the Order will be as specified in the Schedule hereto.
  4. The occupiers of the properties numbered 29 to 79 (odd numbers only)
    Scotchbarn Lane; 1 to 27 and 45 (odd numbers only), Mine’s Avenue; 10 to 46 and 46c (even numbers only) St James Road and 1 and 2, Sutherland Road are excluded from the effects of the restriction referred to in paragraph 1.above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.

Alternative routes for pedestrians affected by the order:

Passageway A – from number 10 St Jame’s Road in a southerly direction to its junction with Scotchbarn Lane then in an easterly direction along Scotchbarn Lane to its junction with Mine’s Avenue then in a northerly direction along Mine’s Avenue to number 1 Mine’s Avenue and vice versa.

Passageway B – from number 46 St Jame’s Road in a northerly direction to its junction with Bretherton Road then along Bretherton Road in an easterly direction to its junction with Mine’s Avenue then along Mine’s Avenue in a southerly direction to number 27 Mine’s Avenue and vice versa.

Passageway A to B – from number 10 St Jame’s Road in a northerly direction to Bretherton Road then in an easterly direction along Bretherton Road to its junction with Mine’s Avenue then along Mine’s Avenue in a southerly direction to its junction with Scotchbarn Lane then along Scotchbarn Lane in a westerly direction to its junction with St Jame’s Road then in a northerly direction back to number 10 St Jame’s Road and vice versa.

Passageway C – from number 2 Mine’s Avenue in a southerly direction to its junction with Scotchbarn Lane then in an easterly direction along Scotchbarn Lane to its junction with Sutherland Road then in a northerly direction along Sutherland Road to number 1 Sutherland Road and vice versa.

Passageway D – from number 2 Sutherland Road in a southerly direction along Sutherland Road to its junction with Scotchbarn Lane then in an easterly direction along Scotchbarn Lane to its junction with the passageway adjacent to the side of number 79 Scotchbarn Lane then in a northerly direction along the passageway to the rear of number 2 Sutherland Road and vice versa.

The Common Seal of the council was affixed on 5 March 2008.
