Gating Order - Retford Walk, Kirkby

Highways Act 1980
This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Retford Walk area of Kirkby.
By this Order:
- The public right of way over the passageway located to the
front of numbers 1 to 9, Retford Walk and to the front of numbers 2
to 14, Retford Walk, Kirkby in the Metropolitan Borough of Knowsley
will be restricted at all times by the erection of a barrier
positioned in line between the boundaries of numbers 6 and 8
Retford Walk and the westerly boundary of number 1, Retford
Walk.
- The Authority are satisfied that:
(a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
(b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
(c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour. - The alternative route for pedestrians will be from the boundary
between numbers 6 and 8 Retford Walk in a southerly direction for a
distance of approximately 49 metres to its junction with Brechin
Road then in an easterly direction along Brechin Road to its
junction with Minstead Avenue then in a northerly direction along
Minstead Avenue for a distance of approximately 61 metres to its
junction with Retford Road then in a westerly direction for a
distance of approximately 54 metres to its junction with Retford
Walk and along Retford Walk in a southerly direction and vice
versa.
- The occupiers of the properties numbered 1, 6 and 8, Retford
Walk are
excluded from the effects of the restriction referred to in paragraph 1.above. - Police, Fire and Ambulance emergency services, statutory
undertakers with equipment situated over, along or in the highway,
council officers and other persons authorised in writing by the
council for the purposes of carrying out works of repair or
maintenance to the highway or ajoining premises shall be exempt
from the provisions of this Order.
- The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.
If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.
The Common Seal of the council was affixed on 5 March 2008.
