Gating Order - Rufford Close, Whiston

Knowsley Metropolitan Borough Council intends to make the above order under section 129A of the Highways Act 1980 in the form set out in the Schedule to this notice. The highways affected, the effect of the order and the identified alternative route are as set out in that Schedule.

A copy of the proposed Order may be seen free of charge during normal office hours and copies may be purchased at the price of £2.50 at the Reception Desks of the Council’s Offices at:

Any representations about or objections to the making of the Order may be sent in writing to the Borough Solicitor and Secretary, Municipal Buildings, Archway Road, Huyton, Knowsley, Merseyside, L36 9YU not later than 4th March 2008. Please state the grounds on which they are made.

If no such representations or objections are duly made, or if any so made are withdrawn, Knowsley Metropolitan Borough Council will proceed to make the Order.

Schedule
Highways Act 1980

This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Rufford Close area of Whiston.

By this Order:

  1. The public right of way over the passageway located between number 1, Rufford Close and 13 Steward Court, running for a distance of approximately 32 metres in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers at its junctions with Rufford Close and its northerly boundary between numbers 1, Rufford Close and 13, Steward Court.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative route for pedestrians will be from the front of number 13 Steward Court in a south-easterly direction for a distance of approximately 95 metres to its junction with Cable Road then in a southerly direction along Cable Road for a distance of approximately 210
    metres to its junction with Shaw Lane then in a north-easterly direction along Shaw Lane for a distance of approximately 41 metres to its junction with Brook Street then in a northerly direction for a distance of approximately 234 metres to its junction with Warrington Road then
    along Warrington Road in a north-westerly for a distance of approximately 126 metres to the passageway adjacent to number 210 Warrington Road and along the passageway in a south-westerly direction for a distance of approximately 32 metres and vice versa.

  4. The occupiers of the properties numbered 1, Rufford Close and 13 Steward Court are excluded from the effects of the restriction referred to in paragraph 1.above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.
