Gating Order - Mercer Avenue/Richard Hesketh Drive, Kirkby

This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Mercer Avenue and Richard Hesketh Drive area of Kirkby.

By this Order:

  1. The public right of way over the highway commencing at its junction with Mercer Avenue at a point adjacent to the most southerly point of the rear of number 1, Harron Close and continuing in a north-easterly direction for a length of approximately 145 metres to its junction with Richard Hesketh Drive at the most north-easterly point of the boundary of Westvale Community Centre in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers positioned between the most southerly point of the rear of number 1, Harron Close and the south-easterly boundary of Westvale Sea Cadets Centre off Mercer Avenue and between the south-easterly boundary of Westvale Community Centre and the north-westerly boundary of Westvale Social Club off Richard Hesketh Drive
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative route for pedestrians is from the southerly boundary of the rear of number 1, Harron Close in a north-westerly direction for a distance of approximately 86 metres along Mercer Avenue to its junction with Oatlands Road, then in a north-easterly direction along Oatlands Road for a distance of approximately 145 metres to its junction with Richard Hesketh Drive then in a south-easterly direction for a distance of approximately 94 metres to the south-easterly boundary of Westvale Community Centre and vice versa.
  4. The occupiers of the properties numbered 1 to 9 (inclusive) Harron Close; Westvale Community Centre, Oatlands Road; Westvale Sea Cadets Centre, Oatlands Road and Westvale Social Club, Richard Hesketh Drive are excluded from the effects of the restriction referred to in paragraph 1. above
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.

The common seal of the Council of the Metropolitan of Knowsley was affixed on 27 February 2008.
