Gating Order - Various roads, Prescot (No.2)

This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Albany Road and Wycherley Street area of Prescot.

By this Order:

  1. The public right of way over the alleyways specified in the First Schedule hereto in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers as specified in the Second Schedule hereto.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative routes for pedestrians affected by the restrictions are as specified in the Third Schedule hereto.
  4. The occupiers of the properties numbered 2 and 20 to 42 (even numbers only) Grosvenor Road; 1 to 5 (inclusive) Grosvenor Court; 1 to 7 (odd numbers only) Wycherley Street; 2 to 12 (evens numbers only) Wycherley Street; The Fusilier Public House, Warrington Road; 3 to 61, 73 and 75 (odd numbers only) Warrington Road; The Reform Club, Warrington Road; 2 to 42 (even numbers only) Queens Road; 1 to 33 (odd numbers only) Queens Road; 2 to 62 (even numbers only) Columbia Road; 1 to 51 (odd numbers only) Columbia Road; 1 to 65 (odd numbers only) Albany Road are excluded from the restrictions referred to in paragraph 1. above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.

First schedule

Alleyway A runs to the rear of numbers 3 to 11 Warrington Road for a distance of approximately 32 metres; 1 to 7 Wycherley Street; 2 Grosvenor Road and the side of the Fusilier Public House and 3 Warrington Road for a distance of approximately 41 metres; and 2 to 40 Evans Street for a distance of approximately 50 metres as shown on plan number NR/PWC/RA/GO1028.

Alleyway B runs to the rear of numbers 13 to 17 Warrington Road for a distance of approximately 18 metres and numbers 2 to 12 Wycherley Street for a distance of approximately 27 metres as shown on plan number NR/PWC/RA/GO1027.

Alleyway C runs to the rear of numbers 27 to 45 Warrington Road for a distance of approximately 80 metres; 20 to 42 Grosvenor Road for a distance of approximately 57 metres and 1 to 33 Queens road for a distance of approximately 85 metres as shown on plan number NR/PWC/RA/GO1024.

Alleyway D runs to the rear of numbers 47 to 61 Warrington Road for a distance of approximately 52 metres; 2 to 42 Queens Road for a distance of approximately 104 metres and 3 to 51 Columbia Road for a distance of approximately 118 metres as shown on plan number NR/PWC/RA/1025.

Alleyway E runs to the rear of 73 to 75 Warrington Road for a distance of approximately 43 metres; 1 to 65 Albany Road for a distance of approximately 144 metres and 2 to 62 Columbia Road for a distance of approximately 130 metres as shown on plan number NR/PWC/RA/GO1026.

Second schedule

Alleyway A – gates located adjacent to the front of number 3 Warrington Road and the Fusilier Public House; adjacent to the front of number 1 Wycherley Street and the rear of 11 Warrington Road and the rear of number 2 Grosvenor Road as indicated by thick black lines on plan number NR/PWC/RA/GO1028.

Alleyway B – gates located adjacent to the rear of number 13 Warrington Road and the front of number 2 Wycherley Street and adjacent to the rear of number 12 Grosvenor Road and the side of Grosvenor Court as indicated by thick black lines on plan number NR/PWC/RA/GO1027.

Alleyway C – gates located between the fronts of numbers 27 and 29 Warrington Road; adjacent to the front of number 1 Queens Road; adjacent to the front of number 42 Grosvenor Road and the rear of number 33 Queens Road and at the rear of number 20 Grosvenor Road as indicated by thick black lines on plan number NR/PWC/RA/GO1024.

Alleyway D – gates located between the rear of number 51 Columbia Road and the rear of number 42 Queens Road; adjacent to the front of number 2 Queens Road and adjacent to the front of number 3 Columbia Road as indicated by thick black lines on plan number NR/PWC/RA/GO1025.

Alleyway E – gates located adjacent to the front of number 2 Columbia Road; adjacent to the front of number 1 Albany Road; between the front of number 23 and the front of number 25 Albany Road and between the rear of number 65 Albany Road and the rear of number 62 Columbia Road as indicated by thick black lines on plan number NR/PWC/RA/GO1026.

Third schedule

Alternative routes for pedestrians affected by the restrictions:-

Alleyway A – the alternative route is from the rear of 2 Grosvenor Road in an easterly direction to Wycherley Street then along Wycherley Street in a south-westerly direction to Warrington Road then in a westerly direction along Warrington Road and vice versa.

Alleyway B – the alternative route is from the gate located at the rear of number 12 Wycherley Street on Grosvenor Road in westerly direction to Wycherley Street then along Wycherley Street and vice versa.

Alleyway C – the alternative route is from the gate adjacent to the rear of number 20 Grosvenor Road in a northerly direction to Grosvenor Road then in an easterly direction along Grosvenor Road to Queens Road then in a southerly direction along Queens Road to Warrington Road then in a north-westerly direction along Warrington Road to the gate adjacent to number 27 Warrington Road and vice versa.

Alleyway D – the alternative route is from the gate adjacent to the rear of number 42 Queens Road in a westerly direction to Queens Road then in a southerly direction along Queens Road to Warrington Road then in a south-easterly direction to Columbia Road then in a northerly direction to the gate adjacent to the rear of number 61 Warrington Road and vice versa.

Alleyway E – the alternative route is from the gate adjacent to the rear of number 62 Columbia Road in a westerly direction to Columbia Road then in a southerly direction along Columbia Road to Warrington Road then in a south-easterly direction to Albany Road then in a northerly direction to the gate adjacent to number 23 Albany Road and vice versa.

The Common Seal of the Knowsley Council was affixed on 24 September 2008.
