Gating Order - Various roads, Prescot (No.1)

Knowsley Metropolitan Borough Council intends to make the above order under section 129A of the Highways Act 1980 in the form set out in the Schedule to this notice. The highways affected, the effect of the order and the identified alternative route are as set out in that Schedule.

This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Eaton Street and Moss Street area of Prescot.

By this Order:

  1. The public right of way over the alleyways specified in the First Schedule hereto in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers as specified in the Second Schedule hereto.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative routes for pedestrians affected by the restrictions are as specified in the Third Schedule hereto.
  4. The occupiers of the properties numbered 3 to 33 (odd numbers only)
    Ward Street; 2 to 40 (even numbers only) and Prescot Chapel,
    Evans Street; 1A and 1 to 35 (odd numbers only) Evans Street; 31 to 49
    (odd numbers only) St Helens Road; 1 to 12 (inclusive) Rio Court; 30 to
    40 (even numbers only) Moss Street; 1 to 29 (odd numbers only) Eaton
    Street; 1 to 14 (inclusive) Aron Court; Hope and Anchor Public House
    and 35 to 45 (odd numbers only) High Street; 1 to 34 (inclusive) Hope
    Street and 1 to 6 (inclusive) Eaton Place are excluded from the
    restrictions referred to in paragraph 1 above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.

First schedule

Alleyway A runs to the rear of numbers 3 to 33 Ward Street for a distance of approximately 75 metres; 57 to 63 St Helens Road for a distance of approximately 41 metres; and 2 to 40 Evans Street for a distance of approximately 102 metres as shown on plan number NR/PWC/RA/GO1030.

Alleyway B runs to the rear of numbers 1a to 35 Evans Street for a distance of approximately 92 metres; numbers 31 to 49 St Helens Road for a distance of approximately 52 metres; numbers 1 to 12 Rio Court for a distance of approximately 48 metres; and numbers 30 to 40 Moss Street for a distance of approximately 30 metres as shown on plan number NR/PWC/RA/GO1031.

Alleyway C runs to the rear of numbers 1 to 26 Eaton Street for a distance of approximately 84 metres; 1 to 14 Aron Court for a distance of approximately 84 metres; 2 to 34 Hope Street for a distance of approximately 76 metres; and the Hope and Anchor Public House to 45 High Street for a distance of approximately 23 metres as shown on plan number NR/PWC/RA/GO1032.

Alleyway D runs to the rear of numbers 1 to 33 Hope Street for a distance of approximately 79 metres; and 1 to 6 Eaton Place for a distance of approximately 25 metres as shown on plan number NR/PWC/RA/1033. 

Second schedule 

Alleyway A – gates located adjacent to the front of number 3 Ward Street; approximately 23 metres north west of St Helens Road adjacent to the front curtilage of number 2 Evans Street and Moss Street adjacent to the rear of Prescot Gospel Hall as indicated by thick black lines on plan number NR/PWC/RA/GO1030.

Alleyway B – gates located between the rear of number 49 St Helens Road and the front curtilage of number 1a Evans Street; at the front of numbers 11/12 Alexander House; at the rear of number 30 Moss Street adjacent to the front cartilage of numbers 1/2 Alexander House and between to the front of number 40 Moss Street and the rear of number 35 Evans Street as indicated by thick black lines on plan number NR/PWC/RA/GO1031.

Alleyway C – gates located at the rear of number 1 Eaton Street adjacent to the front of number 14 Moss Street; at the rear of number 34 Hope Street adjacent to the front of number 29 Eaton Street and adjacent to the front of number 2 Hope Street at the rear of the Hope and Anchor Public House as indicated by thick black lines on plan number NR/PWC/RA/GO1032.

Alleyway D – gates located at the rear of number 33 Hope Street adjacent to Eaton Place and to the rear of number 1 Hope Street as indicated by thick black lines on plan number NR/PWC/RA/GO1033.

Third schedule

Alternative routes for pedestrians affected by the restrictions:-

Alleyway A – the alternative route is in a southerly direction from the rear of the Gospel Hall to Evans Street then along Evans Street in an easterly and south easterly direction to St Helens Road then in a north easterly direction to Ward Street then along Ward Street and vice versa.

Alleyway B – the alternative route is from the gate located at the rear of number 49 St Helens Road in a south-easterly direction to St Helens Road then in a south-westerly direction to Rio Court then in an easterly direction along Rio Court to Moss Street then in a northerly direction to Evans Street then in an easterly direction along Evans Street and vice versa.

Alleyway C – the alternative route is from the gate adjacent to number 14 Moss Street in a northerly direction to Eaton Street then in a westerly direction along Eaton Street to Hope Street then in a south-easterly direction along Hope Street to the gate adjacent to number 2 Hope Street and vice versa

Alleyway D – the alternative route is from the gate adjacent to the rear of number 33 Hope Street in an easterly direction to Hope Street then in a south-easterly direction along Hope Street then in a westerly direction to the gate at the rear of number 1 Hope Street and vice versa.
