Gating Order - Windsor Road, Huyton
This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Windsor Road area of Huyton.
By this Order:
- The public right of way over the highway to the rear of
properties numbered 16 to 30 Bedburn Drive, the rear of properties
numbered 52 to 56 Howden Drive and adjacent to properties numbered
61 to 81 Windsor Road in the Metropolitan Borough of Knowsley will
be restricted at all times by the erection of a barrier positioned
between the properties numbered 30 Bedburn drive and 81 Windsor
Road.
- The Authority are satisfied that:
(a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
(b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
(c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour. - As the highway is a cul-de-sac there is no alternative route
for pedestrians.
- The occupiers of the properties numbered 52 to 56 (even numbers
only) Howden Drive; 16 to 30 (even numbers only) Bedburn Drive and
61, 61a, 63, 63a, 71, 71a, 73, 73a, 75, 75a, 77, 77a, 79, 79a, 81
and 81a (odd numbers only) Windsor Road are excluded from the
effects of the restriction referred to in paragraph 1. above
- Police, Fire and Ambulance emergency services, statutory
undertakers with equipment situated over, along or in the highway,
council officers and other persons authorised in writing by the
council for the purposes of carrying out works of repair or
maintenance to the highway or ajoining premises shall be exempt
from the provisions of this Order.
- The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.
If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.
