Gating Order - Pool Hey and Little Moss Hey, Stockbridge Village

Knowsley Metropolitan Borough Council intends to make the above order under section 129A of the Highways Act 1980 in the form set out in the Schedule to this notice. The highways affected, the effect of the order and the identified alternative route are as set out in that Schedule.

A copy of the proposed Order may be seen free of charge during normal office hours and copies may be purchased at the price of £2.50 at the Reception Desks of the Council’s Offices at:

The Halewood One Stop Shop, Raven Court, Halewood

Any representations about or objections to the making of the Order may be sent in writing to the Borough Solicitor and Secretary, Municipal Buildings, Archway Road, Huyton, Knowsley, Merseyside, L36 9YU not later than 7th February 2008. Please state the grounds on which they are made.

If no such representations or objections are duly made, or if any so made are withdrawn, Knowsley Metropolitan Borough Council will proceed to make the Order.

Schedule
Highways Act 1980

This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Pool Hey and Little Hey areas of Stockbridge Village.

By this Order:

  1. The public right of way over the footpath commencing adjacent to number 66 Pool Hey; the footpath between the front of number 34 and the rear of number 35 Pool Hey; the footpath between the front of number 25 and the rear of number 34 Pool Hey; the footpath between the front of number 15 and the rear of number 25 Pool Hey and the pathway under the flyover bedroom between numbers 8 and 9 Pool Hey and the pathway under the flyover bedroom between numbers 106 and 107 Little Moss Hey in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers at the southerly end of the footpath adjacent to number 66 Pool Hey (marked A on the attached plan numbered NR/NH/PC/GO1020); the easterly end of the footpath between numbers 34 and 35 Pool Hey (marked B on the said plan); the easterly end of the footpath between numbers 25 and 34 Pool Hey (marked C on the said plan); the easterly end of the footpath between numbers 15 and 25 Pool Hey (marked D on the said plan); the pathway between numbers 8 and 9 Pool Hey (marked E on the said plan) and the pathway between numbers 106 and 107 Little Moss Hey
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative routes for pedestrians affected by the restrictions are as follows:

    From the gate adjacent to number 66 Pool
    Hey in a north- easterly direction to the rear number 66 Pool Hey; then
    in a north-westerly direction to the rear of number 71 Pool Hey; then in a
    south-easterly then south-westerly direction back to the gate marked A
    and vice versa.

    From the gate at the rear of number 35
    Pool Hey in a south-easterly direction to the rear of number 26 Pool Hey
    then in an easterly then south-westerly direction along Pool Hey to
    number 1 Pool Hey then in a westerly then a north-westerly direction
    along Haswell Drive to Milestone Hey then in north-easterly direction
    along Milestone Hey back to the gate marked B and vice versa.

    From the gate at the rear of number 25
    Pool Hey in a south-easterly direction to Pool Hey then in a south-
    westerly direction to Haswell Drive then in a north-westerly direction to
    Milestone Hey then in a north-easterly then south-easterly direction from
    Milestone Hey back to the gate at the rear of number 25 Pool Hey and
    vice versa.

    From the gate at the rear of number 15
    Pool Hey in a south-easterly direction to Pool Hey then in a south-
    westerly direction to Haswell Drive then in a north-westerly direction for
    a distance of approximately 28 metres to Pool Hey.

    From the gates in a south-westerly
    direction along Pool Hey to Haswell Drive then in a southerly direction to
    Pool Hey then in an easterly then north-easterly direction along Pool Hey
    to the corner of number 8 Pool Hey then in a north-westerly direction
    along the footpath to number 15 Pool Hey and vice versa.

    From the gate at the front of and between numbers 106 and 107 Little
    Moss Hey along the footpath fronting numbers 97 to 106 Little Moss Hey
    then in a south-westerly direction along the footpath fronting numbers 61
    to 66 Little Moss Hey then along the footpath fronting numbers 82 to 92
    Little Moss Hey to the gate at the rear of and between numbers 106 and
    107 Little Moss Hey and vice versa.

  4. The occupiers of the properties numbered 8, 9, 15, 25, 34, 36 and 66
    (inclusive) Pool Hey and 106 and 107 Little Moss Hey are excluded from
    the effects of the restrictions referred to in paragraph 1.above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.
