Gating Order - Forest Drive, Huyton

This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Forest Drive area of Huyton.

By this Order:

  1. The public right of way over the footpath to the rear of numbers 25 to 39 Stanhope Drive; the highway between and to the rear of numbers 10 and 12 Forest Drive and the rear of numbers 2 to 8 and 14 to 20 Forest Drive and numbers 17 to 27 Spinney Way and the footpath to the rear of numbers 17 to 25 Western Avenue in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers at the easterly ends of the footpaths adjacent to numbers 2 and 20 Forest Drive, and the highway between numbers 10 and 12 Forest Drive as shown by thick black lines on the attached plan.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. There is no alternative route for pedestrians affected by the restrictions as the area affected is a cul-de-sac.
  4. The occupiers of the properties numbered 2 to 20 (even numbers only)
    Forest Drive; 17 to 25 (odd numbers only) Western Avenue; 25 to 43 (odd
    numbers only) Stanhope Drive and numbers 17 to 27 inclusive Spinney
    Way are excluded from the effects of the restrictions referred to in
    paragraph 1 above.

  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.

The Common Seal of Knowsley Council was affixed on 24 September 2008.
