Schedule
Highways Act 1980

This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Beldon Crescent/Beechburn Crescent area of Huyton.

By this Order:

  1. The public right of way over the alleyway to the rear of numbers 32 and 34 Beldon Crescent and 45 to 65 (odd numbers only) Beechburn Crescent commencing at the most south-westerly point of the rear boundary of number 34 Beldon Crescent and continuing in an easterly direction for a distance of approximately 52 metres to a point adjacent to the rear boundaries of numbers 53 and 55 Beechburn Crescent in the Metropolitan Borough of Knowsley will be restricted at all times by the erection of barriers at the easterly and westerly ends of the alleyway.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative route for pedestrians affected by the restrictions is from the proposed barrier at the westerly end of the alleyway in a northerly direction and then an easterly direction along the footpath that fronts numbers 53 to 65 Beechburn Crescent then in a southerly then south westerly direction to the proposed barrier at the eastern end of the alleyway, a total distance of approximately 123 metres.
  4. The occupiers of the properties numbered 45 to 65 (odd numbers only)
    Beechburn Crescent and numbers 32 and 34 Beldon Crescent are
    excluded from the restrictions referred to in paragraph 1.above.
  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this order on the ground that the council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the order, he or she may apply to the High Court within six weeks from the date which the order is made.
