Gating Order - Craigwood Way and Woodlands Road, Huyton
This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Craigwood Way and Woodlands Road area of Huyton.
By this Order:
- The public right of way over the passageway commencing at the
most southerly boundary of number 9 Craigwood Way and continuing in
a northerly direction for a distance of approximately 45 metres to
the most northerly boundary of number 14 Craigwood Way, Huyton in
the Metropolitan Borough of Knowsley will be restricted at all
times by the erection of barriers at each end of the
passageway.
- The Authority are satisfied that:
(a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
(b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
(c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour. - The alternative route for pedestrians will be from the proposed
gate location to the rear of number 9 Craigwood Way in a westerly
direction alongside the southerly boundary of number 9 Craigwood
Way, then in a northerly direction along the footpath that fronts
numbers 9 to 14 Craigwood Way, then in an easterly direction
alongside the northerly boundary of number 14 Craigwood Way to the
proposed second gate location and vice versa..
- The occupiers of the properties numbered 9 to14 (inclusive)
Craigwood Way and 57 to 69 (odd numbers only) Woodlands Road,
Huyton are excluded from the effects of the restriction referred to
in paragraph 1above.
- Police, Fire and Ambulance emergency services, statutory
undertakers with equipment situated over, along or in the highway,
council officers and other persons authorised in writing by the
council for the purposes of carrying out works of repair or
maintenance to the highway or ajoining premises shall be exempt
from the provisions of this Order.
- The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.
If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.
The Common Seal of the Council of the Metropolitan Borough of
Knowsley was hereunto affixed on 26 September
2007.
