Gating Order - Glynne Grove, Huyton



This order is made by Knowsley Metropolitan Borough Council ("the authority") under section 129A - G of the Highways Act 1980 because it appears to the Authority that a Gating Order would be beneficial for tackling crime and anti-social behaviour in the Glynne Grove area of Huyton.

By this Order:

  1. Access to the public right of way over the passageway commencing between numbers 6 and 7 Glynne Grove and continuing in a westerly and then a north-westerly direction to the rear of number 7 Glynne Grove in the Metropolitan Borough of Knowsley will be restricted to between the hours of 8.00am and 6.00pm (1st October to 31st March inclusive) and between the hours of 8.00am to 9.00pm (1st April to 30th September inclusive) by the erection of a barrier at the eastern end of the passageway leading from Glynne Close and the north western end of the passageway leading from Court Hey Park, which will be kept closed at all other times.
  2. The Authority are satisfied that:

    (a) Premises adjoining or adjacent to the higway are affected by crime and/or anti-social behaviour;
    (b) The existence of the highway is facilitating the persistant commission of criminal offences and/or anti-social behaviour;
    (c) It is in all circumstances expedient to make this Order for the purposes of reducing crime and/or anti-social behaviour.
  3. The alternative route for pedestrians will be via Glynne Grove then south along Gladstone Avenue to its junction with Edenhurst  Avenue, then in a westerly drection along EdenhurstAvenue continuing via the footbridge along St Paschal Baylon Boulevard to Chelwood Avenue, then turning in a north-westerly direction to the entrance into Court Hey Park, then in a north-easterly direction through Court Hay Park, a total distance of approximately 680 metres.
  4. The occupiers of the properties numbered 31 Keswick
    Way:7 GlynneGrove; 8 Glynne Grove and St Paschal Balyon RC
    Primary School are excluded from the effects of the restriction referred to
    in paragraph 1 above.

  5. Police, Fire and Ambulance emergency services, statutory undertakers with equipment situated over, along or in the highway, council officers and other persons authorised in writing by the council for the purposes of carrying out works of repair or maintenance to the highway or ajoining premises shall be exempt from the provisions of this Order.
  6. The person responsible for maintaining the barriers is Knowsley Metropolitan Borough Council, Department of Regeneration and Neighbourhoods, Yorkon Building, Archway Road, Huyton, Knowsley, Merseyside, L36 9UX.

If any person desires to question the validity of this Order on the ground that the Council had no power to make it, or any requirement of part 8A of the Act has not been complied with in relation to the Order, he or she may apply to the High Court within six weeks from the date which the Order is made.

The Common Seal of the Council of the Metropolitan Borough of Knowsley was hereunto affixed 1 August 2007.
