Private and compulsory property purchase
This is when the Council, Government
or a utility company has been granted
the power to buy or take rights over
your private property. This may happen
if it falls within a public or private
construction project such as, housing
regeneration or redevelopment area /
project. Knowsley council believes
that purchasing private property
should be done as a volunatary process
following consultation with the owner
and other powers used as a last
resort.
Different compulsory purchase or statutory powers are required to implement Compulsory Purchase Orders (CPO's), however in all cases, the owners and occupiers of the properties to be acquired or affected by the scheme will be served Notices.
Prior to a CPO being granted there is a preliminary process which involves consultation with those concerned. If any objections are received to the proposed CPO, a Public Inquiry is held by an Inspector who is appointed by the Government, who is then tasked with objectively assessing the need for the CPO. The Inspector will consider all objections and will make an appropriate recommendation to the Secretary of State as to whether the CPO should be granted.
CPO proposals will provide compensation to owners and occupiers directly affected by the scheme.
