Under the Environmental Protection Act 1990 all businesses are required by law to dispose of their waste properly.

All businesses that produce 'controlled waste' (that is all forms of commercial and industrial waste) will be subject to what is called the 'Duty of Care'. This means that you must, by law, take all reasonable steps to look after any waste you have and prevent its escape or illegal disposal by others.

All businesses must:

• have valid transfer notes/trade waste agreement in place with their waste disposal contractor
• have adequate bins with closed lids to properly contain their waste
• ensure that the bins are adequate for the amount of waste being produced
• store bins in a secure area and keep tidy

Failure to adhere to any of these rules means you could be fined up to £300 per offence or face prosecution by the council.

We will be randomly checking businesses throughout the borough to ensure they are doing their bit to control their waste.
