What are the penalties
- The manager or person in control of the smoke-free premises could face a fine of up to £1000 on summary conviction, or a fixed penalty notice of £200 for failing to display appropriate signage in no smoking premises and vehicles.
- Individuals could face on the spot fines of up to £50 for smoking in a smoke-free place.
- The manager or person in control could face a maximum fine of £2500 for failing to prevent smoking in no-smoking premises and vehicles.
How will the law affect my business?
If your premises are covered by the smoke-free law, you, your staff, customers and visitors will not be allowed to smoke in the enclosed areas of your premises.Who's going to enforce all of this - the smoke police?
It is likely that any visiting enforcement officer from Knowsley MBC, be it Environmental Health, Licensing, or Trading Standards, will be checking compliance with this legislation as part of their routine inspections. You will be expected to take all reasonable measures such as displaying statutory no-smoking signs and ensure that staff and visitors are aware of the new law. If he/she refuses, implement your normal procedure for anti-social/illegal behavior in the premises. In all cases where physical violence or intimidation is threatened or encountered, seek the assistance of the police.
